FRESNO — A former dispatcher and customer service representative is suing her employer, alleging retaliation, unpaid wages and wrongful termination.
Brittany Nielsen-Jones filed a complaint Sept. 14 in Fresno County Superior Court, alleging Gust Express Inc., California Refrigerated and Does 1-50, failed to protect the rights of its employee.
According to the complaint, Nielsen-Jones worked for the defendants as a dispatcher and customer service representative for 19 months until April 21, 2017. The suit says she was fired due to her complaints about the unwanted and pervasive harassing conduct of another employee, unpaid overtime wages, and unpaid meal and rest period breaks she did not take.
The plaintiff alleges the defendants failed to pay overtime, failed to provide meal and rest periods, failed to reimburse her for business expenses, failed to provide accurate and itemized wage statements, and failed to pay all wages owed at termination.
Nielsen-Jones seeks trial by jury, compensatory and punitive damages, restitution and/or disgorgement, costs of suit, interest and all equitable relief the court deems just. She is represented by attorneys Michael J. Lampe and Mlchael P. Smith of Law Offices of Michael J. Lampe in Visalia.
