FRESNO — A Madera County woman is suing Ford, alleging breach of warranty in selling a defective vehicle.
Jorene Mize of North Fork filed a complaint Sept. 26 in Fresno County Superior Court against Ford Motor Company and Does 1-10, alleging they obtained profit through unfair or deceptive trade or commerce.
According to the complaint, Mize, on June 29, 2012, purchased a new 2012 Ford Focus. Mize says she has suffered monetary damages because the vehicle was delivered with serious transmission and engine defects and in substandard condition. The suit says the car subsequently developed other serious flaws.
The plaintiff alleges the defendants rendered the vehicle unfit for sale, and failed to repair the defects and non-conformities or to replace or repurchase the vehicle.
Mize seeks trial by jury, general, special and actual damages, rescission of the purchase contract, incidental and consequential damages, civil penalty, interest, attorney fees, costs of suit and all relief the court deems just.
