Disabled man accuses Fresno sports club of discrimination

SACRAMENTO — A disabled man is suing property owners of a sports club, alleging disability discrimination and failure to uphold Americans with Disabilities Act regulations.

Christopher Seldon filed a complaint Oct. 20 in U.S. District Court for the Eastern District of California against George Brown Sports Club Palm LLC, Tingey Properties LLC, Park Place Holdings LP,Tutelian & Co. In., and Does 1-20, alleging they failed to provide full and safe equal access to its facilities.

According to the complaint, Seldon is an amputee who requires the use of a wheelchair, scooter or crutches for mobility. The suit says Seldon has made more than 300 visits to GB3-Palm and and Park Place Shopping Center, and each time he encounters difficulty and frustration trying to find and use the parking facility. 

The plaintiff alleges the defendants failed to make their goods, services, facilities, privileges, advantages and/or accommodations available to individuals with disabilities.

Seldon seeks trial by jury, general and special damages of at least $1,000 for each violation, injunctive relief, attorney fees, court costs and all further relief the court deems proper. He is represented by attorney Steven L. Derby of Derby, McGuinness & Goldsmith LLP in Oakland.
