Chinese technology company accuses competitor of patent infringement

SAN DIEGO — A Chinese technology company is suing a competitor, alleging patent infringement.

Cywee Group Ltd. filed a complaint Oct. 17 in the U.S. District Court for the Southern District of California against ZTE Corporation, ZTE (USA) Inc., and ZTE (TX) Inc., alleging they breached good faith and fair dealing.

According to the complaint, Cywee Group, which develops motion processing, wireless high definition video delivery and facial tracking technology, has suffered damages from the wrongful conduct of the defendants. The suit says the defendants directly infringed the plaintiffs' ’438 and '978 patents by making, using, selling, and/or importing into the United States products that embody the patents.

The plaintiff alleges the have illegally obtained profit at the expense of Cywee Group, and introduced an infringing product into the stream of commerce.

Cywee Group seeks trial by jury, judgment for damages, accounting of all gains and profits, and all relief and remedies available. It is represented by attorney Kent M. Walker of Lewis Kohn & Walker LLP in San Diego.
