Disabled man accuses fitness club owners of discrimination

SACRAMENTO — A disabled man is suing Fresno fitness facility property owners and operators, alleging disability discrimination, violation of the Americans with Disabilities Act (ADA) and Violation of the Unruh Act.

Christopher Seldon filed a complaint on Oct. 20 in U.S. District Court for the Eastern District of California against George Brown Sports Club Palm LLC, Tingey Properties LLC, Park Place Holdings LP, Tutelian & Co. Inc. and Does 1-20, alleging they failed to provide full and safe equal access to its facilities.

According to the complaint, since January 2015, Seldon has made more 300 visits to defendants' property at 7825 N. Palm Ave., Fresno, and each time he has encountered difficulty and frustration trying to find and use the parking facility. The suit says he has also encountered numerous barriers that prevented him full access within defendants' property. 

The plaintiff alleges the defendants failed to provide a sufficient number of accessible parking slots as mandated by law and allowed patrons to park in accessible parking slot without the proper display of credentials.

Seldon seeks trial by jury, general and special damages of at least $4,000, trebling of actual damages, injunctive relief, attorney fees and costs, and all relief the court deems proper. He is represented by attorney Steven L. Derby of Derby, McGuinness & Goldsmith LLP in Oakland.
