Father blames swimming pool owners, operators for son's death

FRESNO — A father is suing operators of a Fresno swimming pool, alleging negligence caused the wrongful death of his son.

Lee Thao filed a complaint Sept. 26 in Fresno County Superior Court against Jose Jam Li, Elizabeth Jam Li, Jam Li Jose, Elizabeth Living Trust; Elizabeth Reyna Valle, Gougnia Thao and Does 1 through 30, alleging violation of the California Swimming Pool Safety Act.

According to the complaint, the defendants' negligence allowed Jaycee Thao, a 3-year-old child, to climb the fence at 5293 E. Heaton Ave., Frenso, and enter the swimming pool without the supervision of homeowner's mother. The suit says the child drowned. 

As a result, Lee Thoa suffered the loss of love, society, comfort, affection, services and support of his child. 

The plaintiff alleges the defendants failed to follow regulations in maintaining swimming pool area under California Health and Safety Code by failing to place items along a pool fence to keep minor child from entering the pool and failed to provide proper supervision.

Thao seeks trial by jury, economic damages of more than $10,000, costs of suit, and all other proper and just relief. He is represented by attorney Henry H. Leim of Law Offices of Henry H. Liem in San Jose.
