Employee alleges real estate business failed to pay proper wages

FRESNO — A Fresno County woman is suing a real estate business, alleging unpaid wages.

Leticia Medeiros filed a complaint Oct. 2, in Fresno County Superior Court against Pacific Living Properties Inc., and Does 1-50, alleging violation of the California Industrial Welfare Commission Order and the California Labor Code.

According to the complaint, in 2015, Medeiros was employed Pacific Living under an employment agreement that was partly written, partly oral and partly implied. Medeiros says she worked in shifts in excess of 40 hours per week but was failed to be provided with meals, rest breaks as required by the labor code and failed to receive overtime pay. 

Medeiros allegedly suffered loss of earnings. The plaintiff says the defendants failed to pay for all hours worked, failed to compensate for overtime work at one and one-half times the regular rate as required by the Fair Labor Standards Act or pay for hours worked in excess of 40 hours per week and failed to provide meal periods.

Medeiros seeks trial by jury,compensatory damages of $50 for the initial violation and $100 for each subsequent violation, restitution of all monies due, damages pursuant to the FLSA, costs of suit incurred, attorney fees, and all other just and proper relief.
