Passenger blames car owner, driver for injuries in crash

FRESNO — A vehicle passenger is suing the car's owner and driver, alleging their negligence caused a crash that led to injuries for the plaintiff.

Khamphanh Srimala filed a complaint Oct. 3 in Fresno County Superior Court against Valerie Molina and Samuel Ortega Gonzalez, alleging they failed to operate and maintain vehicle in a proper manner to avoid injuring others and their property.

According to the complaint, on Nov. 2, 2015, Molina was driving co-owned vehicle with Samuel Ortega Gonzalez westbound on state Highway 180 in Fresno County when she lost control of the vehicle, which caused injuries to Srimala, who was a passenger in the vehicle. 

As a result, he suffered numerous personal injuries, incurred costs for medical treatment and suffered wage losses. 

The plaintiff alleges Molina and Gonzalez negligently, carelessly and recklessly entrusted, owned, controlled, drove, operated, loaded and maintained their vehicle, causing injuries and damages to a passenger.

Srimala seeks trial by jury, compensatory damages of at least $25,000, costs of suit, and all fair, just and equitable relief. He is represented by attorney Sarges G. Atanous of The Dunnion Law Firm in Monterey.
