SAN DIEGO — A San Diego County man is suing Discover Bank, alleging misrepresentation in debt collection.
Bruce Williams filed a complaint Nov. 1 in U.S. District Court for the Southern District of California against Trans Union LLC; Experian Information Solutions, Inc. and Discover Bank, alleging violation of the Fair Credit Reporting Act.
According to the complaint, on May 10, Williams became aware that his credit report provided by the defendants were inaccurate due to an alleged debt included despite the fact he already filed for bankruptcy in November 2013.
As a result, Williams says he he suffered loss of credit, embarrassment of credit denials and emotional pain.
The plaintiff alleges the defendants failed to conduct a reasonable investigation to determine whether the disputed information was inaccurate and failed to correct erroneous negative and derogatory reports.
Williams seeks trial by jury, actual and punitive damages between $100 and $1,000 for each willful violation, court costs, litigation, attorney fees and all other relief the court deems just and proper. He is represented by attorney Daniel Forde of Hoffman & Forde in San Diego.
