Disabled man accuses Sacramento property owners of disability discrimination

SACRAMENTO — A quadriplegic man is suing Sacramento property owners, alleging disability discrimination and failure to uphold Americans with Disabilities Act regulations.

Scott Johnson filed a complaint Nov. 2 in U.S. District Court for the Eastern District of California against Chae Sun Lee, Mihn Tam Hoang and Does 1-10, alleging they failed to provide full and safe equal access to its facilities at 5017 and 5037 Stockton Blvd.

According to the complaint, Johnson, who must use a wheelchair, visited the defendants' property, the site of Long Island Ice Cream and New Star Massage, on several occasions. The suit says Johnson was subjected to discrimination every time from the insensitive and unlawful conduct of the defendants who negligently failed to maintain accessible parking spaces and facilities intended for persons with physical disabilities. 

The plaintiff alleges the defendants denied him full and equal access and caused him difficulty and frustration, and failed to ensure that the accessible facilities were available and ready to be used by everyone.

Johnson seeks trial by jury damages of at least $4,000, injunctive relief, attorney fees, litigation expenses and costs of suit. He is represented by attorney Isabel Masanque of Center for Disability Access in San Diego.
