Driver alleges motorist ran traffic signal, caused crash

FRESNO — A Fresno County vehicle driver is suing another motorist and Hertz, alleging failure to obey a traffic signal and causing a collision.

Robert Alvillar filed a complaint Oct. 20 in Fresno County Superior Court against Jose Arriola and The Hertz Corporation, alleging the defendants failed to drive and maintain their vehicle in a safe manner.

According to the complaint, on June 9, Alvillar was driving northbound on Clovis Avenue, approaching the intersection with Golden State frontage road. The suit says Ariolla, driving a rented Hertz car, ran a red light at the intersection and crashed into Alvillar's vehicle. . 

As a result, Alvillar says sustained physical injuries, lost wages and incurred medical bills. 

The plaintiff alleges Ariolla failed to keep a proper lookout, failed to apply brakes, failed to yield right of way and used his cell phone while driving.

Alvillar seeks trial by jury, compensatory damages in excess of $25,000, plus costs of suit and all fair, just and equitable relief. He is represented by attorney Lance H. Kirk of AA Accident Attorneys in Newport Beach.
