FRESNO — A Fresno County tenant is suing a commercial property owner, alleging breach of contract, breach of lease agreement, trespass and wrongful eviction.
Abdo Mohammed Saad filed a complaint Oct. 24 in Fresno County Superior Court against Derek Kazanjian and Does 1-50, alleging they breached their duty of good faith and fair dealing.
According to the complaint, on Sept. 3, 2016, Saad was damaged for lost profits and the loss of good will of his business, and suffered severe emotional distress over the loss of his livelihood, as a result of the defendants' wrongful possession of the leased premises at 1915 First St., Selma, where Saad had been a tenant since 1996..
The plaintiff alleges the defendants interfered with Saad's right to use and possess the leased premises, and illegally entered a leased property without the consent of the lessee or authority of the courts.
Saad seeks trial by jury, general, special and punitive damages, attorney fees, interest, costs of suit, and all relief the court deems just and proper. He is represented by attorneys Jody L. Winter, Jennifer J. Panicker and Sean A. Fredin of Lloydwinter PC in Fresno.
