Car owner blames Ford for faulty vehicle

FRESNO — A Fresno woman resident is suing Ford, alleging breach of an implied warranty due to a defective vehicle.

Kathryn Perry filed a complaint Oct. 19 in Fresno County Superior Court against Ford Motor Company, and Does 1 through 20, alleging violation of the Song-Beverly Consumer Warranty Act.

According to the complaint, on May 16, 2014, Perry signed a conditional sales contract to purchase a 2012 Ford Fiesta accompanied by the vehicle's express warranty. The suit says the warranty stated the car was fit for the purpose for which its was being purchased. Perry says she discovered the Ford Fiesta was defective, failed to perform properly and has failed to conform to the terms of the express and implied warranties. 

The plaintiff alleges Ford is unable or unwilling to conform the vehicle to its express warranty after a reasonable number of repair attempts.

Perry seeks trial by jury, rescission of the contract, actual and exemplary damages, attorney fees, costs of suit, prejudgment interest, and all just and proper relief. She is represented by attorney Alicia L. Hinton of Law Office of A.L. Hinton in Fresno.
