Consumer reporting agency accused of violating FCRA

SACRAMENTO — A Sacramento County man is suing a consumer reporting agency, alleging violations of the Fair Credit Reporting Act (FCRA).

Adam Alessi filed a complaint Nov. 15 in U.S. District Court for the Eastern District of California Sacramento Division against Equifax Information Services LLC, Experian Information Solutions Inc. and Herbert P. Sears Co. Inc., doing business as HP Sears, alleging they failed to take adequate steps to verify information.

According to the complaint, Alessi suffered damages by loss of credit, loss of ability to purchase and benefit from credit, and the anguish, humiliation and embarrassment of credit denial. The plaintiff blames the wrongful conduct of the defendants to follow procedures to assure maximum possible accuracy in the preparation of Alessi's credit report and credit files and to promptly delete information when notified that inaccurate information was disputed by the plaintiff. 

The plaintiff alleges the defendants failed to correct erroneous personal information regarding Alessi, failed to promptly and adequately investigate information, and failed to note in the credit report that the plaintiff disputed the accuracy of the information.

Alessi seeks trial by jury, damages together with attorney fees and court costs. He is represented by attorney Jonathan A. Stieglitz of The Law Offices of Jonathan A. Stieglitz in Los Angeles.
