Sister accuses brother of fraud

FRESNO — A Santa Cruz County woman is suing her brother, alleging fraud and unjust enrichment.

Peggy N. Amaya filed a complaint Oct. 25 in Fresno County Superior Court against Robert M. Blackhurst and Does 1-10, alleging they breached their duties of good faith and fair dealing regarding property at 37526 Ripple Lane, Squaw Valley, California.

According to the complaint, on Feb. 19, 2015, Amaya expended funds and suffered extreme emotional distress, as a result of the malicious conduct of Blackhurst in refusing to transfer title to the real property back to the plaintiff.

The suit says the Squaw Valley property was purchased and maintained with Amaya's funds, and Blackhurst was to hold in trust for Amaya only until such time the plaintiff felt safe to name the property after her, given her contentious divorce with a convicted felon. 

The plaintiff alleges the defendants pocketed the discount Blackhurst  negotiated with the seller, refused to pay for utilities, repairs and maintenance, and preyed upon Amaya's vulnerability and his inherent position of trust as a family member.

Amaya seeks trial by jury, general, special and punitive damages, judicial declaration, attorney fees, costs of suit, and all relief the court deems proper. She is representing herself.
