FRESNO — An agriculture company is suing a Fresno customer, alleging breach of contract.
JR Simplot Company, doing business as Simplot Grower Solutions filed a complaint Oct. 25 in Fresno County Superior Court against Jose Ochoa and Does 1-100, alleging they failed to pay more than $57,000 for services rendered.
According to the complaint, on Jan. 12, 2012, Simplot Grower Solutions entered into a commercial sales agreement, wherein the defendants were given the right to purchase services and goods on credit. However, the suit says, the defendants breached the contract by failing to pay Simplot the amounts due and owing for products and services acquired.
The plaintiff alleges the defendants failed to make payments of past-due principal and interest, received and benefited from the products and services acquired from Simplot and obligated the plaintiff to retain and pay for legal counsel.
Simplot Grower Solutions seeks trial by jury, damages of $57,430.11, plus interest, attorney fees, costs of suit and all relief the court deems just. It is represented by attorney Rebecca H. Sem of Kroloff, Belcher, Smart, Perry & Christopherson APLC in Stockton.
