Creditor alleges borrower owes $44,000 for promissory note

FRESNO — A creditor is suing a borrower, alleging the defendant owes more than $44,000 for breach of promissory note.

Hitachi Capital America Corp. filed a complaint Oct. 26 in Fresno County Superior Court against Lakhvir S. Pandher, also known as Lakhvir Singh Pandher and Does 1-10, alleging they breached their duties of good faith and fair dealing.

According to the complaint, on March 23, 2015, Hitachi Capital America executed a motor vehicle security agreement for $104,270.88 with Pandher. The suit says Hitachi has suffered economic damages as a result of defendants' wrongful conduct of failing to pay for all amount due and owing under the agreement entered into with the plaintiff. 

The plaintiff alleges the defendants has refused and neglected to pay $44,369.47 in accordance with the terms of the note, failed to surrender possession of collateral, and has received and benefited from the amount acquired from plaintiff.

Hitachi Capital America seeks trial by jury, judgment for the principal sum of $44,369.47, plus interest, attorney fees, costs of suit and all relief the court deems just. It is represented by attorney Richard A. Solomon of Solomon, Grindle, Lidstad & Wintringer APC in San Diego.
