A business owner is suing insurer and agents for breach of contract

FRESNO — A Fresno County man is suing Lloyd's of London Insurance, alleging breach of contract, negligence and negligent misrepresentation.

Avtar Singh filed a complaint Oct. 26 in Fresno County Superior Court against Lloyd's London Insurance, Valley's Best Insurance Services LLC, Syuzanna Gyulazyan and Does 1-10, alleging they breached their duty of good faith and fair dealing.

According to the complaint, on Aug. 11, Singh suffered monetary damages from the defendants' refusal to pay him the full amount of loss as reported. The suit says the pretextual reason given was that the driver/employee of Singh had less than the required commercial driving experience, despite repeated assurance from the defendants that the new driver, Didar Singh, was covered under Avtar Singh' insurance policy prior to the incident. 

The suit says Didar Singh was driving a tractor and trailer that rolled off the road in Lake County, Indiana, and caused a cargo loss of $69,978.80

The plaintiff alleges the defendants failed to procure the requested and agreed upon coverage, and failed and refused to pay Avtar Singh plaintiff the full amount of the loss without legal cause or right,.

Singh seeks trial by jury, special, general, economic, incidental and consequential damages, attorney fees, interest, costs of suit, punitive damages, and all further relief the court deems just. He is represented by attorney Brian N. Folland of The Folland Law Firm in Fresno.
