Carpet, flooring business alleges subcontractor breached contract

FRESNO — A Fresno County carpet and flooring business is suing a subcontractor, alleging alleged breach of contract, negligence and negligent misrepresentation.

Don Boam Carpet and Flooring filed a complaint Oct. 30 in Fresno County Superior Court against Osbaldo Amparan, Amparan Flooring Inc., Forbo Flooring inc. and Does 1-50, alleging that they breached their duty of good faith and fair dealing.

According to the complaint, on April 21, Don Boam Carpet and Flooring discovered that the flooring installation done by the defendants at the intensive care unit of Selma Community Hospital, was immensely defective. The suit says the flooring, including the doors, drywall, and glass, needed to be removed and reinstalled at a substantial expense. 

The plaintiff alleges the defendants breached the contract by failing to competently install the flooring as agreed upon, and failed to use a certified installer.

Don Boam Carpet and Flooring seeks trial by jury, actual, compensatory, incidental, punitive and consequential damages, attorney fees, court costs and all other relief the court deems just. They are represented by attorney George J. Vasquez of Fresno.
