LOS ANGELES — A disabled man who requires a wheelchair is suing Anaheim property owners, alleging disability discrimination and failure to uphold Americans with Disabilities Act regulations.
Rafael Arroyo Jr. filed a complaint Nov. 22 in U.S. District Court for the Central District of California against Northwest Dealerco Holdings LLC, Beach 76 Corporation and Does 1-10, alleging they failed to provide full and safe equal access to their Anaheim facilities.
According to the complaint, in October, Arroyo was caused difficulty and frustration from visiting the defendants' gas station at 100 N. Beach Blvd., Anaheim. The suit says the property is not accessible to wheelchair users, and although plaintiff would like to return and patronize the business, he will be deterred from visiting until the violations are remedied.
The plaintiff alleges the defendants failed to make reasonable modifications in policies, practices or procedures, and failed to remove architectural barriers where such removal is readily achievable.
Arroyo seeks trial by jury, injunctive relief, actual damages and a statutory minimum of $4,000, plus attorney fees, litigation expenses and costs of suit. He is represented by attorney Isabel Masanque of Center for Disability Access in San Diego.
