Kern County produce business alleges manufacturer breached contract

FRESNO — A Kern County produce company is suing a manufacturer, alleging breach of contract.

Sunnygem Produce LLC, doing business as Buena Vista Juice Company, filed a complaint Nov. 16 in Fresno County Superior Court against Mid Valley Packaging and Supply Company and Does 1-25, alleging they breached good faith and fair dealing.

According to the complaint, Buena Vista Juice suffered monetary damages from having entered into an agreement with Mid Valley to provide containers for the plaintiff's pomegranate seeds so they could be sold commercially. 

The suit says Buena Vista Juice paid more than $30,000 for the containers to be produced but the defendant failed to produce the correct size to fit the plaintiff's products. 

The plaintiff alleges the defendants failed to perform its obligations to provide the proper cups to hold Buena Vista's product, and forced the plaintiff to pay for legal counsel to protect its interest.

Buena Vista Juice seeks trial by jury, compensatory and punitive damages, and all further relief the court deems just. It is represented by attorney Matthew J. Durket of Law Office of Matthew J. Durket APC in El Dorado Hills.
