Fresno company alleges customer owes $353,000

FRESNO — A Fresno limited partnership is suing a customer, alleging breach of contract.

B 17 LP filed a complaint Nov. 17 in Fresno County Superior Court against Roberts. F. Underwood, and Does 1 through 25, alleging the defendants breached the contract by failure to pay $353,000 for the account receivable.

According to the complaint, on July 27, B17 P agreed to purchase it account receivable for the sum of $353,000 with payment due by Oct. 31, 2017 to AggCap Insurance Ltd. The suit says Underwood did not pay the agreed price in accordance with the terms and condition of the contract. 

The plaintiff alleges the defendants breached his obligations and duties to act fairly and in good faith by failing to timely compensate for the account receivable as set forth in the agreement and failed and refused to carry out his duties and obligations in a timely manner.

B 17 P seeks trial by jury, damages of $353,000 with interest, plus costs incurred, attorney fees, and all other relief the court deems just and proper. It is represented by attorney Justin T. Campagne of Campagne & Campagne in Fresno.
