Deere alleges debtor, agents owe more than $70,000

FRESNO — Deere is suing a Fresno County man, alleging breach of contract.

Deere & Company filed a complaint Nov. 20 in Fresno County Superior Court against Kyle Jae Maddox and Does 1-50, alleging they failed to pay off a loan contract. 

According to the complaint, on July 9, 2014, Deere & Company's assignor, Midland Tractor Company, assigned all right, title and interest to a loan contract entered into with Maddox, stating that the defendants are required to pay a borrowed sum of $26,088.97 for the purchase of farm equipment. However, the suit says, the defendants managed to pay only two full payments and one partial payment. 

The plaintiff alleges the defendants have failed to perform the remaining payment obligations under the contract, and failed to pay all annual installment payments when due.

Deere & Company seek trial by jury, the unpaid principal sum of $73,206.59, plus interest, attorney fees, costs of suit, and all further relief the court deems just. It is represented by attorney Kevin P. Whiteford of Serlin & Whiteford LLP in Sacramento.
