Patient alleges medical providers' negligence caused eye injuries

FRESNO — A Madera County woman is suing medical providers, alleging negligence caused her to suffer eye injuries.

Laurie Toschi filed a complaint Nov. 29 in Fresno County Superior Court against Dr. David Kaye, Dr. Loan Nguyen and David B. Kaye MD Inc., doing business as Natural Vision,  and Does 1 - 20, alleging they failed to exercise standard care and skill required of medical providers and facilities.

According to the complaint, on Aug. 12, 2015, Toschi went to Natural Vision in Madera, California, to have her eyes examined due to blurry vision. The suit says Dr. Kaye performed surgery on her right eye Sept. 29, 2015, with a lens implant, followed by another surgery Oct. 19, 2015.

The lawsuit states there were additional surgeries Nov. 21, 2016, and Jan. 3, 2017 and other doctors visits.

The suit says Toschi has suffered injury to her left eye, total loss of vision and disfigurement, mental and physical pain, loss of earnings, and future medical attention and hospital related expenses, as a result of the defendants' negligent diagnosis and treatment of her eye conditions. 

The plaintiff alleges the defendants failed to disclose to Toschi the risks involved in performing an invasive surgical procedure, failed to properly conduct the surgery, and failed to properly prescribe medications.

Toschi seeks trial by jury, general damages for medical related expenses, for lost and future earnings, interest, costs of suit, and all other relief the court deems just. She is represented by attorney Nicholas E. Aniotzbehere of Yarra Law Firm in Fresno.
