Biofuels business accuses law firm of negligence

FRESNO — A Fresno County biofuels company is suing a Santa Ana law firm, alleging negligence.

Central Valley Bio-Fuels LLC filed a complaint Nov. 28 in Fresno County Superior Court against Mark S. Rosen, Law Office of Mark S. Rosen and Does 1-10, alleging the defendants failed to exercise standard skill required of law practitioners.

According to the complaint, on Aug. 4,Central Valley Bio-Fuels suffered damages from the judgment of the court to dismiss action against the city of Orange Cove. The case involved damages suffered by plaintiff due to a 2007 fire that resulted from a mistake or negligence by the defendants in their performance of legal services to protect the interests of Central Valley Bio-Fuels.

The suit says Central Valley Bio-Fuels made a claim for restitution of of equipment and labor for $199,398.

The plaintiff alleges the defendants failed to file the motion and/or advance the trial date and failed to ensure that the action was brought to trial within five years of filing the complaint.

Central Valley Bio-Fuels seeks trial by jury, damages of at least $1 million, costs of suit, and all further relief the court deems just. They are represented by attorney Michael L. Farley of Farley Law Firm in Visalia.
