Disabled customer alleges Church's Fried Chicken violated ADA

LOS ANGELES — A disabled man who requires a wheelchair is suing Church's Fried Chicken, alleging disability discrimination, failure to uphold Americans with Disabilities Act (ADA) regulations, negligence and unfair competition.

George Lee filed a complaint Dec. 13 in U.S. District Court for the Central District of California against Cajun Operating Company, doing business as Church's Fried Chicken No. 3104, and Does 1-10, alleging they denied full access to the physically disabled.

According to the complaint, on March 28, Lee suffered discrimination, injury and damages from being denied full and equal access and enjoyment of the services, programs, goods, amenities and activities offered at Church's Fried Chicken, 5101 Imperial Highway, South Gate, California, because of the illegal architectural barriers situated therein. 

The plaintiff alleges the defendants failed to comply with the federal standard for the restroom, failed to maintain the parking space designated for persons with disabilities, failed to mark the space with the International Symbol of Access and failed to provide the access aisles with level surface slopes.

Lee seeks trial by jury statutory, general and treble damages, preliminary and permanent injunction, restitution, attorney fees, litigation expenses, costs of suit, interest and all further relief the court deems just.
