Cayucos land owners accuse contractor, subcontractors of negligence

FRESNO — A Cayucos couple is suing a contractor and subcontractors, alleging breach of contract, fraud, negligence and unfair competition.

Frank Fichera and Carol Fichera filed a complaint Dec. 5 in Fresno County Superior Court against Pius Construction Inc., Brent Lloyd Pius, Diana Karen Pius and Does 1-15, alleging the defendants committed building code violations and failed to properly construct a home. 

According to the complaint, the plaintiffs entered into a written contract with the defendants for the construction of their home at 125 Obispo Ave., Cayucos. The suit says subsequently the home showed signs of construction defects and extremely poor workmanship. 

The plaintiffs allege the defendants failed to properly supervise the construction of the Ficheras'  home, failed to complete the job in a timely and workmanlike manner and failed to perform as required under the agreement.

The Ficheras seek trial by jury, compensatory and punitive damages of at least $225,000, rescission of the contract, incidental and consequential damages, costs of suit, attorney fees and all further relief the court deems just. They are represented by attorneys Mike Chappars and Robert C. Abrams of Law Office of Robert C. Abrams in Fresno.
