Couple accuses Ford of breach of warranty

FRESNO — A couple is suing Ford, alleging breach of warranty.

Benny and Dolores Mendoza filed a complaint Dec. 5 in Fresno County Superior Court against Ford Motor Company and Does 1-100, alleging the defendants obtained profit through distribution of a substandard product.

According to the complaint, on Oct. 12, 2016, Benny and Dolores Mendoza purchased a 2015 Ford Fiesta for $19,308.56. The suit says they have suffered damages because the vehicle contained or developed defects while the implied warranty was still in effect. 

The plaintiffs allege Ford Motor Company breached the terms of the warranty by failing to adequately repair or promptly replace the Mendozas' vehicle.

The Mendozas seek trial by jury, damages of at least $19,308.56, restitution to plaintiff in the amount of at least $19,308.56, a civil penalty of $38,617.12, and any consequential and incidental damages. They are represented by attorney Christian S. Scott of Scott Law Group PC in San Diego.
