Doctor accuses Fresno medical facility of discrimination

FRESNO — A licensed physician is suing Fresno medical facilities, alleging discrimination.

Dr. David B. Kaye filed a complaint Dec. 6 in Fresno County Superior Court against Fresno Surgery Center doing business as Fresno Surgical Hospital, FSC Hospital, LLC, et al., alleging violation of the California Unruh Civil Rights Act.

According to the complaint, in 2016, while working as a doctor at defendants' facility, Kaye, who is an Orthodox Jew, was subjected to discrimination against his race, national origin, religious beliefs and ethnicity. Kaye says he suffered offensive and derogatory remarks and statements, false allegations that he did not want to work at the facility and was removed his scheduled surgeries. 

The plaintiff alleges the defendants made public statements that were damaging to Kaye's personal and professional reputations in the community, with existing and prospective business associates and removed his privileges and rights just because of his race, ethnicity and beliefs.

Kaye seeks trial by jury, general, special and treble damages, attorney fees, punitive damages and all other relief the court deems just and proper. He is represented by attorney Russel K. Ryan of Motschiedler, Michaelides, Wishon, Brewer & Ryan, LLP in Fresno.
