LOS ANGELES — An environmental group is suing a California laboratory, alleging violation of the Clean Water Act (CWA).
Our Clean Waters filed a complaint Nov. 21 in U.S. District Court for the Central District of California against Aircraft X-Ray Laboratories Inc. and Does 1-10, alleging they failed to exercise reasonable care and caution for the protection of the environment.
According to the complaint, the defendant is illegally discharging storm water that contains elevated concentrations of pollutants from their facility into surface water of the Los Angeles River and the Pacific Ocean.
The plaintiff alleges Aircraft X-Ray Laboratories has failed to develop and implement an adequate monitoring and reporting program (M&RP) and storm water pollution prevention plan (SWPPP) for the facility.
Our Clean Waters seeks trial by jury, declaratory and injunctive relief and civil penalties of not less than $10 million and $37,500 per day, per violation to restore the quality of the impaired waters, court costs and all further relief the court deems just.
