Disabled woman accuses Fresno property operators of disability discrimination

SACRAMENTO — A woman with disabilities is suing Fresno property operators, alleging disability discrimination and failure to uphold Americans with Disabilities Act regulations.

Rachel Bryant, who requires a wheelchair, filed a complaint Dec. 21 in U.S. District Court for the Eastern District of California against Tahoe Joe's Inc., doing business as Tahoe Joe's No. 822, and Cedar Point Investors LP, alleging they unlawfully denied full access to the physically disabled.

According to the complaint, on Oct. 2, 2017, Bryant was at Tahoe Joe's, 7006 N. Cedar Ave., Fresno to buy food. Bryant alleges she suffered discrimination, injury and damage from being denied full and equal access and enjoyment of the services, programs, goods, amenities and activities being offered at the defendants' property, because of the illegal architectural barriers. 

The plaintiff alleges the defendants failed to remove architectural barriers, failed to make the required services available to disabled people through alternative methods, and failed to make modifications in policies, practices or procedures.

Bryant seeks trial by jury, injunctive relief, statutory minimum damages of $4,000 per offense, attorney fees, litigation expenses, costs of suit, interest and all further relief the court deems proper. She is represented by attorney Zachary M. Best of Mission Law Firm APC in San Jose.
