Bipolar sufferer accuses Turlock police of excessive force

SACRAMENTO — A man who suffers from Bipolar Disorder is suing Turlock police officers, alleging battery, excessive force, intentional infliction of emotional distress and negligence.

Travis Mihalovic filed a complaint Dec. 21, in the U.S. District Court for the Eastern District of California against the city of Turlock, Turlock police officers Hiram Duncan, Ian Rodrgiuez, Gregory Roton, and Does 1-50, alleging they caused life-threatening injuries pain and suffering.

According to the complaint, on Nov. 10, 2016, Mihalovic was experiencing a medical emergency and was involved in a loud dispute with his mother at their home, 368 West Ave., Turlock, leading to the arrival of  Turlock police officers. The suit says Mihalovic suffered physical injury, emotional distress, pain and suffering, loss of income, medical expenses, fear, trauma, and humiliation, due to the negligent and intentional actions of the police officers in their excessive and unreasonable use of force and conduct committed against the  plaintiff. 

The plaintiff alleges the defendants touched Mihalovic with the intent to harm or offend him, violated his constitutional right, failed to timely summon medical care for Mihalovic, and failed to discipline officers for their use of excessive force against the plaintiff.

Mihalovic seeks trial by jury, general, special, punitive and statutory damages of no less than $4,000, an additional $25,000, attorney fees, costs of suit, and all further relief the court deems just. He is represented by attorney John L. Burri of Law Offices of John L. Burris in Oakland.
