FRESNO — A Fresno County general contractor is suing a subcontractor, alleging breach of contract.
Lewis C. Nelson and Sons Inc. of Selma, California, filed a complaint Dec. 7 in Fresno County Superior Court against James Joseph Compos, doing business as Compos Construction, Suretec Indemnity Company and Does 1-50, alleging they owe more than $300,000.
According to the complaint, on Aug. 4, 2017, Nelson and Sons entered into a written subcontract agreement with Compos to furnish all necessary labor, material, tools, equipment and supplies for remodeling work at the Holiday Inn Swan Court, 2950 Pea Soup Anderson Blvd., Selma. The suit says Nelson and Sons suffered economic damages because although the plaintiff has performed all the terms and conditions required by the subcontract, the defendants breached the agreement by their untimely and deficient performance on the project.
The plaintiff alleges the defendants failed to timely perform project work in accordance with the subcontract, failed to properly pay its employees and provide documentation showing the same, and failed to honor project obligations.
Lewis C. Nelson and Sons seeks trial by jury, compensatory damages in excess of $300,000, interest, costs of suit, attorney fees, consequential damages and all further relief the court deems just.
