Motorist blames intoxicated driver for causing crash

FRESNO — A motorist is suing another driver, alleging negligence in driving while intoxicated.

Amy Johnson filed a complaint Dec. 15 in Fresno County Superior Court against Priscilla Consuelo Diaz, Delia Smart and Does 1-50, alleging they failed to exercise standard care and skill required in operating a vehicle.

According to the complaint, on Feb. 20, 2016, Johnson was driving at the intersection of East Ness Avenue and North La Entrada in Fresno. when she was hit by a speeding vehicle driven by Diazs who was intoxicated from alcohol and/or drugs. The suit says Johnson suffered physical, mental and emotional injuries, wage loss and loss of use of property, plus hospital and medical expenses.  

The plaintiff alleges Diaz, who had a history of drunk driving, failed to adequately maintain and operate a motor vehicle so as not to cause harm, fled from the scene of the accident in an attempt to avoid financial responsibility and criminal prosecution, and illegally drove a vehicle while under the influence of drugs and/or alcohol.

Johnson seeks trial by jury, compensatory and punitive damages of more than $25,000, costs of suit and all other fair and just relief. She is represented by attorney Robert G. Gilmore of Law Office of Robert G. Gilmore in Fresno.
