Former county employee accuses Fresno of retaliation

FRESNO — A former county employee is suing a Fresno government agency and officers, alleging retaliation.

Gloria Guerrero filed a complaint Dec. 13 in Fresno County Superior Court against the county of Fresno, the Fresno County Department of Social Services, Social Services director Delfino E. Neira, and Does 1-25, alleging they failed to exercise reasonable care and caution for the treatment of its workers.

According to the complaint, Guerrero began working as an office assistant for the Department of Social Services in February 2016 after 22 years working for Santa Clara County. Guerrero says she was subjected to harassment, intimidation and unprofessional conduct from her supervisor.

The lawsuit states Guerrero has suffered and will continue to suffer damages from lost wages, lost benefits,and was further harmed on the evaluation and her subsequent termination as retaliation for having complained about her supervisor to management. 

The plaintiff alleges the defendants permitted their employee, Victor Cervantes, to subject Guerrero to unprofessional conduct and a hostile work environment, and retaliated against the plaintiff for complaining about his behavior.

Guerrero seeks trial by jury, general, special, and compensatory damages, declaratory and injunctive relief, interest, attorney fees, costs of suit and all further relief the court deems proper. She is representing herself. .
