Motorist blames pizza business, drivers for causing crash

FRESNO — A motorist is suing a pizza business owner and driver, alleging negligence caused a crash that injured the plaintiff.

Tracy Bourbon filed a complaint Dec. 6 in Fresno County Superior Court against Pacifica Pizza, Lawrence Joseph Vasquez, Gilbert Vasquez and Does 1 to 30, alleging the defendants maintained and failed to control a pizza delivery vehicle in such a way as to cause a collision with another vehicle.

According to the complaint, on Nov. 19, 2017, Bourbon was driving near the intersection of East Clinton Avenue and North Van Ness Boulevard in Fresno. Bourbon says she was struck by a Pacifica Pizza vehicle operated by Joseph Vasquez and Gilbert Vasquez. 

As a result, Bourbon says she sustained physical injuries, lost the use of property and had to pay hospital expenses. 

The plaintiff alleges Lawrence Joseph Vasquez and Gilbert Vasquez failed to keep proper lookout, failed to yield right of way and failed to take proper control of vehicle.

Bourbon seeks trial by jury, damages in excess of $25,000, plus costs of suit and all fair, just and equitable relief. She is represented by attorney Darryl B. Freedman of Law Office of Darryl B. Freedman Inc. in Fresno.
