Inmate accuses detention facility of prosecutorial misconduct

SAN DIEGO — A Carlsbad man is suing a San Diego County detention facility and its officers, alleging malicious abuse of process.

Bruce Thomas filed a complaint Dec. 29 in U.S. District Court for the Southern District of California against the county of San Diego, Bonnie M. Dumanis, Drew W. Garrison and Callan E. Smith, alleging the defendants deprived him of due process in state court, bringing forth a miscarriage of justice and imprisonment in the San Diego County Jail.

According to the complaint, from May 17-May 23, 2017 and then from June 20-Sept, 30, 2017, Thomas was in the custody of the San Diego sheriff at the East Mesa detention facility due to the defendants' egregious misconduct and failure to attend his hearings that resulted in false imprisonment. As a result, Thomas says, he was cheated out of due process in the state of court and battered by two jail inmates. 

The plaintiff alleges the defendants failed to appear for trial, willfully abused the legal process by deceiving the court with a fraudulent pleading writ to avoid suppression of evident and failed to intervene when they had the opportunity and duty to prevent prosecutorial misconduct.

Thomas seeks trial by jury, compensatory, punitive damages, reasonable costs, attorney fees and all further relief the court deems just, proper and appropriate. The plaintiff is representing himself.
