FRESNO — A disabled woman is suing the owners of an Atwater liquor store, alleging disability discrimination and failure to uphold Americans with Disabilities Act (ADA) regulations.
Aurora Cervantes, who suffers from systemic lupus erythematosus, filed a complaint Dec. 29 in U.S. District Court for the Eastern District of California Fresno Division against ASJA Investments LLC, Narinderpal Singh and Nishan Singh, doing business as Bernie's Liquors, and Does 1-50, alleging they denied full access to the physically disabled.
According to the complaint, in April 2017, Cervantes suffered difficulty and embarrassment, as a result of the discriminatory acts of the defendants. The suit sahs the defendants prohibited an individual with physical disabilities to fully enjoy the goods, services, facilities and accommodations offered by Bernie's Liquors, 1491 Broadway Ave., Atwater.
The plaintiff alleges the defendants failed to ensure their property was equally accessible to individuals with disabilities and a medical condition, including ADA-compliant accessible parking facilities and proper markings.
Cervantes seeks trial by jury, injunctive relief, statutory and general damages of at least $1,000 for each violation, all litigation expenses, costs of action, attorney fees, and all further relief the court deems just. She is represented by attorney Daniel Malakauskas of Las Vegas.
