Disabled woman accuses Merced business of violating ADA

FRESNO — A woman with disabilities is suing the owners of a Merced business, alleging disability discrimination and failure to uphold Americans with Disabilities Act (ADA) regulations.

Aurora Cervantes, who says she suffers from systemic lupus erythematosus and who has filed 15 lawsuits in the past 12 months, filed a complaint Dec. 29 in U.S. District Court for the Eastern District of California Fresno Division against Paul's Place Inc., 1700 Investors LLC, 1700 Investment II LLC and Does 1-50, alleging they failed to provide full and safe equal access to its facilities.

According to the complaint, in April, May, and July 2017, Cervantes suffered difficulty, discomfort, or embarrassment, from having encountered barriers that interfered with her ability, to use and enjoy the goods, services, privileges and accommodations offered by Paul's Place at 2991 North G St., Merced. 

The plaintiff alleges the defendants failed to ensure the public accommodation is designed, constructed and altered in compliance with the accessibility standards, and failed to avoid discriminating against a disabled individual.

Cervantes seeks trial by jury injunctive relief, appropriate damages of at least $4,000 for each violation, litigation expenses, costs of action, attorney fees, and all further relief the court deems just. She is represented by attorney Daniel Malakauskas of Las Vegas.
