FRESNO — A window cleaner has filed a class action lawsuit against a Fresno company, alleging violation of workers compensation acts.
Stephen Aguirre, on behalf of himself and all other aggrieved employees, filed a complaint Dec. 19 in Fresno County Superior Court against Anlin Industries and Does 1 through 50 , alleging violations of the labor code and civil penalties under the Labor Code Private Attorneys General Act.
According to the complaint, on Oct. 13, 2016, Aguirre and other similarly aggrieved current and former employees worked for Anlin Industries as hourly window cleaners. The suit says they failed to receive rest breaks, timely meal periods and one hour's pay for each workday.
The lawsuit states this was despite the plaintiffs having the classification of a non-exempt employees, entitling to the protections of both the labor code and the wage order calling for overtime pay.
The plaintiff alleges Anlin Industries failed to provide all timely 10-minute rest breaks required by California law, including a third 10-minute rest break when they worked in excess of 10 hours a day and failed to timely pay all earned and unpaid wages during their employment.
Aguiree seeks trial by jury, civil penalties of more than $25,000, costs of suit, attorney fees and all other relief the court deems just and proper. He is represented by attorneys David G. Spivak and Caroline Tahmassian of The Spivak Law Firm in Encino.
