Motorist blames another driver, owner for rear-ending vehicle

FRESNO — A motorist is suing a vehicle owner and operator, alleging negligence caused a rear-end collision that injured the plaintiff.

Rickie E. Whitaker filed a complaint Dec. 19 in Fresno County Superior Court against Shawn Michael Clavin and HD Supply White Cap, alleging they entrusted and operated vehicle in negligent manner so as to cause a collision with another vehicle, resulting in injuries.

According to the complaint, on Oct. 3, 2016, Whitaker was stopped for traffic on state Road 152 in Los Banos. The suit says his car was rear-ended by an HD Supply White Cap's vehicle operated by Clavin. 

As a result, Whitaker says, he sustained bodily injuries, lost of use of property and experienced hospital and medical expenses. 

The plaintiff alleges Clavin failed to operate the vehicle in a safe and reasonable manner and was inattentive and adjusting his radio and did not observe stopped traffic ahead of him.

Whitaker seeks trial by jury, compensatory damages in excess of $25,000, plus costs of suit and all fair, just and equitable relief. He is represented by attorney K. Poncho Baker of Klein, Denatale, Goldner in Fresno.
