SACRAMENTO — A disabled woman who requires a wheelchair is suing a Fresno hotel, alleging failure to uphold Americans with Disabilities Act (ADA) regulations.
Theresa Brooke filed a complaint Jan. 16 in U.S. District Court for the Eastern District of California against Fresno Airport Hotels LLC, doing business as Wyndham Garden Fresno Airport, alleging the defendant denied full access to the physically disabled.
According to the complaint, on Jan.12, when Brooke was at Wyndham Garden Fresno Airport in an attempt to book a room, she experienced discrimination due to the absence of a fixed swimming pool lift or other means of permitting her equal access to defendant’s pool facilities.
The plaintiff alleges Wyndham Garden Fresno Airport failed to make its public lodging services fully accessible to and usable by disabled individuals, and failed to comply with ADA’s requirements.
Brooke seeks trial by jury, damages of at least $4,000, attorney fees, costs of suit and all other relief the court deems just. She is represented by attorney Peter Kristofer Strojnik of The Strojnik Firm LLC in Phoenix.
