Calexico resident accuses city of violating civil rights

SAN DIEGO — A Calexico woman is suing the city of Calexico and its officers, alleging intentional infliction of emotional distress.

Leticia G. Rios filed a complaint Jan. 11 in U.S. District Court for the Southern District of California against city of Calexico, the city's Code Enforcement Division Department and city officials and officers, alleging violation of her state and federal civil rights. 

According to the complaint, in October 2016, Rios suffered illegal searches and subsequent citations. The suit says she continues to suffer fear of loss of her personal belongings and property at 941 E. Sixth St, Calexico, as a result of the defendants' unlawful acts in the illegal search of her property without the necessary warrant or prior notice. 

The plaintiff alleges the defendants deprived her of her constitutional rights to be secure in her property and deprived her of liberty without the due process of law.

Rios seeks trial by jury, general damages of $1 million, special and punitive damages, injunctive relief, attorney fees, costs of suit and all further relief the court deems just. She is represented by attorney Michel R. Huff of Huff Legal PC in Fresco.
