Disabled woman accuses Fresno Holiday Inn of discrimination

SACRAMENTO — A disabled woman is suing a Fresno Holiday Inn, alleging disability discrimination and failure to uphold Americans with Disabilities Act (ADA) regulations.

Theresa Brooke of Pinal County, Arizona, who requires a wheelchair, filed a complaint Jan. 16 in U.S. District Court for the Eastern District of California against Shivam Hospitality Inc., doing business as Holiday Inn Express Fresno River Park in Fresno, alleging failure to provide full and safe equal access to its facilities.

According to the complaint, on Jan. 13, Brooke went to the Holiday Inn Express to book a room. Brooke says the defendant did not provide a proper access aisle in the parking lot or an adequate loading zone closest to the lobby entrance, as required by the ADA. 

The plaintiff alleges Holiday Inn Express Fresno River Park failed to remove architectural barriers to make its lodging services fully accessible to individuals who are disabled, and denied Brooke equal access to its public accommodation on the basis of her disability.

Brooke seeks trial by jury, damages of no less than $1,000 for each code violation and all other relief the court deems just. She is represented by attorney Peter Kristofer Strojnik of The Strojnik Firm LLC in Phoenix.
