LOS ANGELES — A disabled man is suing Torrrance business owners, alleging disability discrimination and failure to uphold Americans with Disabilities Act (ADA) regulations.
Nehemiah Kong, a polio suffered who requires a wheelchair, filed a complaint Jan. 16 in U.S. District Court for the Central District of California against H & A Properties LP, H & A Real Estate Investments Inc., Ocean Foot Spa and Does 1-10, alleging they denied full access to the physically disabled.
According to the complaint, in June 2017, Kong was at 17258 Hawthorne Blvd.,Torrance. The suit says Kong encountered barriers upon his visit to the defendants' establishment, causing him difficulty and frustration. The lawsuit states there was not a single van accessible parking space in the parking lot.
The plaintiff alleges the defendants failed to remove architectural barriers where such removal is readily achievable, and failed to make reasonable modifications in policies, practices or procedures for the disabled.
Kong seeks trial by jury, damages, injunctive relief, actual damages, the statutory minimum of $4,000, attorney fees, litigation expenses and costs of suit. He is represented by attorney Isabel Masanque of Center for Disability Access in San Diego.
