Ace Furniture accused of violating Americans with Disabilities Act

SAN DIEGO — An individual is suing the owner of Ace Furniture, alleging failure to uphold the Americans with Disabilities Act regulations and negligence.

Roy Mason filed a complaint on Jan. 16 in the U.S. District Court for the Southern District of California against Tracy Van Phan Inc., doing business as Ace Furniture, and Does 1-10 alleging they failed to provide proper accommodation to the plaintiff to address his disability.

According to the complaint, the plaintiff alleges that on Aug. 22, 2017 he was not able to access Ace Furniture because it did  not having accessible ramps. 

The plaintiff holds the defendants responsible because they allegedly operated a business that had limited access to disabled individuals including the plaintiff who uses a wheelchair. 

The plaintiff requests a trial by jury; and seeks enjoin the defendants, order the defendants to remove the architectural barriers at the property, award actual, special and statutory damages to the plaintiff, court costs and any further relief this court grants. He is represented by Michael A. Taibi of Taibi & Associates, A.P.C. in San Diego.
