Consumers accuse debt collector of invasion of privacy

SAN DIEGO — A California woman has filed a class action lawsuit against a debt collector, alleging invasion of privacy.

Florence Morris filed a complaint, individually and on behalf of all others similarly situated, Jan. 19 in U.S. District Court for the Southern District of California against Credence Resource Management LLC, alleging telephone privacy violations. 

According to the complaint, since Sept. 19, 2017, Morris and other similarly situated consumers have suffered from invasion of their privacy. The suit says the defendants intentionally illegally recorded telephone conversations without the knowledge or consent of the class members in an attempt to collect an alleged debt. 

The plaintiffs allege Credence Resource Management failed to inform them that the calls were were being recorded and violated the plaintiffs' right to privacy.

The plaintiffs seeks trial by jury, damages of $5,000 per violation, certify the case as a class action and appoint Morris as class representative, injunctive relief, general, special and punitive damages, costs of suit, interest and all further relief the court deems necessary. They are represented by attorney Matthew M. Loker of Kazerouni Law Group APC in Costa Mesa.
