Disabled woman accuses Fresno hotel of disability discrimination

SACRAMENTO — A disabled Arizona woman who requires a wheelchair, is suing a Radisson Hotel in Fresno, alleging disability discrimination, and violation of the Americans with Disabilities Act (ADA) and the Unruh Civil Rights Act.

Theresa Brooke of Pinal County, Arizona,, who has filed numerous disability discrimination lawsuits, filed a complaint Jan. 27 in U.S. District Court for the Eastern District of California against Hi Fresno Hotel Holdings LLC, doing business as Radisson Fresno, alleging failure to to provide full and safe equal access to its facilities.

According to the complaint, on Jan. 13, Brooke suffered discrimination and difficulty upon her attempt to book a hotel room from Radisson Fresno, due to the architectural barriers or lack of ADA-compliant facilities that deterred her from returning to the defendant’s business establishment. 

The plaintiff holds alleges Radisson Fresno interfered with her right to utilize public accommodations free of discrimination, and failed to design and construct ADA-compliant facilities. 

Brooke seeks trial by jury, costs of suit, attorney fees, nominal damages, damages no less than $4,000, and all other relief the court deems just. She is represented by attorney Peter Kristofer Strojnik of The Strojnik Firm LLC in Phoenix.
