FRESNO – An Arizona resident confined to a wheelchair has filed suit against a Fresno hotel over allegations she could not enter it to book a room because the property is not accessible.
Theresa Brooke filed a complaint on Jan. 27 in the U.S. District Court for the Eastern District of California against West Coast Group LLC, doing business as The Hotel Fresno, alleging violation of the Americans with Disabilities Act.
According to the complaint, the plaintiff is legally disabled and is confined to a wheelchair. She alleges on Jan. 13, she went to the defendant's hotel to book a room but could not enter the lobby because each entrance had steps.
The plaintiff holds West Coast Group LLC responsible because the defendant allegedly discriminated against her by failing to make its public services fully accessible.
The plaintiff requests a trial by jury and seeks a judgment against the defendant, award of damages in an amount no less than $4,000, and other relief the court deems just. She is represented by Peter Kristofer Strojnik of The Strojnik Firm LLC in Phoenix, Arizona.
