A person with disability is suing hotel property for disability discrimination

SACRAMENTO — A disabled Arizona woman who requires a wheelchair, is suing a Fresno Rodeway Inn, alleging disability discrimination and failure to uphold Americans with Disabilities Act (ADA) regulations and violation of the Unruh Civil Rights Act.

Theresa Brooke of Pila County, Ariizona, who has filed numerous disability discrimination suits, filed a complaint Jan. 27 in U.S. District Court for the Eastern District of California against Oceanic Fresno LP, doing business as Rodeway Inn & Suites, alleging the hotel property failed to provide full and safe equal access to its facilities for disabled persons.

According to the complaint, on Jan. 13, Brooke went to the Rodeway Inn & Suites, 4141 N. Blackstone Ave., Fresno to book a hotel room. Brooke says she suffered discrimination, embarrassment and difficulty upon her attempt to book the room, due to the architectural barriers or lack of ADA-compliant facilities that further deterred her from returning to Rodeway's business establishment. 

The plaintiff alleges Rodeway Inn & Suites discriminated against her in failing to remove architectural barriers to make its lodging services fully accessible to and independently usable by persons with disabilities.

Brooke seeks trial by jury, damages of no less than $4,000, attorney fees, costs of suit and all other relief the court deems just. She is represented by attorney Peter Kristofer Strojnik of The Strojnik Firm LLC in Phoenix.
